特别提示： 在注册或使用数信云平台之前，请您认真阅读并充分理解《数信云用户协议》（以下简称“本协议”），特别是有关实名认证、服务使用规范、数据安全、服务中止、责任限制、退款及争议解决的条款。涉及您重大权益的条款将以加粗方式提示，请您重点阅读。
当您按照注册页面提示填写信息、阅读并勾选同意本协议，完成账户注册，或通过其他合法有效方式明确接受本协议后，即表示您已阅读、理解并同意遵守本协议的相关约定。
如您不具有完全民事行为能力，请在法定监护人的指导下阅读本协议，并由监护人依法决定是否同意及办理相关手续。
一、缔约主体#
本协议由使用数信云平台的个人、企业或其他组织（以下简称“用户”或“您”）与江苏数信云科技有限公司（以下简称“数信云”“本公司”或“我们”）共同订立。
数信云是由江苏数信云科技有限公司运营的云计算与科研计算服务平台。
二、协议内容和效力#
本协议内容包括本协议正文，以及数信云已经发布或将来依法发布的《隐私政策》《退款政策》、产品使用说明、服务规则、通知及其他相关政策文件（以下简称“平台规则”）。依法有效且已向用户适当公示的相关平台规则构成本协议的组成部分。
数信云有权根据法律法规变化、技术升级及业务运营需要，对本协议及相关规则进行修订。涉及用户重大权益的变更，我们原则上将提前7日通过网站公告、站内通知、邮件或短信等合理方式进行告知；法律法规另有要求的，从其规定。
如果您不同意修改后的协议，可以在变更生效前停止使用相关服务，并根据适用规则办理数据备份、迁移、退订等手续。对于依法需要重新征得同意的变更，数信云将履行相应程序。
如双方另行签订书面服务合同，且其中约定与本协议不一致的，以双方依法有效的特别约定为准。
三、服务内容#
数信云主要面向科研人员、高校、科研机构及其他有计算需求的用户提供云计算资源与相关技术服务，包括但不限于：
云服务器服务：提供基于虚拟化、容器化等技术的独立或共享计算环境。
CPU计算服务：提供多核心CPU计算资源，支持科研计算、数据处理及其他合法计算任务。
GPU计算服务：提供GPU加速计算资源，支持深度学习、生物信息学、人工智能及其他合法计算任务。
存储服务：提供云端数据存储及相关存储资源管理功能。
科研计算环境：提供适用于生物信息学、数据科学及相关领域的计算环境。
管理控制台：通过数信云鲁班控制台及其他管理工具，为用户提供服务器和计算资源管理功能。
数信云负责提供与所购买服务相关的基础设施及平台技术支持，包括服务器运行状态、计算资源、网络连接、存储及平台基础环境等方面的问题排查与处理。
对于用户自行安装的第三方软件、程序代码调试、算法错误、依赖冲突或其他不属于平台基础设施故障的问题，数信云原则上不承担免费技术支持义务。 双方另行约定技术服务的除外。
不同计算产品在CPU、GPU、内存、存储、网络及系统权限等方面可能存在差异。共享计算资源可能受到同时运行任务及资源调度的影响，用户应根据产品说明选择适当配置。
数信云有权根据技术和运营需要，对服务功能、资源调度系统及相关软件进行合理升级、优化和维护。涉及重大服务变更的，应依据本协议及法律法规要求履行通知义务。
四、服务使用规范#
4.1 合法使用#
用户应合法、合理地使用数信云提供的服务器、网络、存储及计算资源，并遵守国家相关法律法规。
以科研计算为主要用途的产品，应按照产品说明使用。未经数信云许可，不得将限制用途的共享服务器用于网站托管、商业服务运营、公共代理转发或其他与产品约定不符的用途。
用户不得利用数信云服务实施以下行为：
未经授权入侵、扫描、攻击其他计算机系统或网络。
传播病毒、木马、勒索软件或其他恶意程序。
开展电信网络诈骗、网络赌博、网络钓鱼及其他违法活动。
部署违法网络代理、非法网络中转或其他违反网络管理规定的服务。
未经平台许可进行虚拟货币挖矿。
未经授权访问其他用户的服务器、文件或数据。
非法收集、传播个人信息或其他受法律保护的数据。
以其他方式危害数信云平台安全、侵害第三方权益或违反法律法规。
4.2 共享资源使用#
使用共享CPU、GPU、内存及存储资源时，用户应遵守对应产品的资源配额与调度规则。
未经许可，不得绕过资源限制、干扰资源调度或通过其他方式持续占用超出产品约定范围的资源。
对于共享服务器，未经许可不得长期部署持续占用大量系统资源的对外服务，包括商业化模型推理接口、公共网络服务等。
数信云有权根据资源使用情况和产品规则采取必要的资源调度、任务限制及异常处理措施，以维护其他用户的正常使用权益。
4.3 实例权限与账户安全#
用户只能访问本人或经合法授权使用的服务器实例及计算资源，不得尝试访问其他用户的实例、文件、系统进程及管理权限。
用户在云服务器或容器内部获得的管理权限，仅限对应实例范围，不代表获得底层物理服务器、宿主机、虚拟化平台或存储集群的管理权限。
禁止通过漏洞利用、容器逃逸、权限提升等方式突破实例隔离边界或访问底层基础设施。
用户应妥善保管账户密码、SSH密钥、访问令牌及其他认证信息，不得出售、出租、出借或非法转让账户。
为保障平台安全，数信云可在合法、正当、必要的范围内对资源使用状态、登录日志、异常网络流量及相关安全事件进行监测和分析。相关个人信息处理应遵守适用法律法规及平台隐私政策。
4.4 实名认证与手机绑定#
根据《中华人民共和国网络安全法》《中华人民共和国反电信网络诈骗法》等相关法律法规要求，数信云对依法需要进行真实身份核验的云服务实行实名认证管理。
使用相关云服务器及云计算服务前，用户应按平台要求提供真实、准确、有效的身份信息，完成相应实名认证。
为加强账户安全、防止账户盗用及便于接收重要安全通知，数信云实行手机号码绑定管理。
未依法完成实名认证的用户，数信云不得向其提供依法要求实名认证的相应云服务。对于未完成平台要求的手机绑定或信息核验的用户，数信云可依法并依照已公示规则，限制相应服务功能或管理控制台的使用权限。
用户应对提交的信息真实性负责，并在认证信息发生变化时及时更新。
数信云将依法保护实名认证信息及其他个人信息，不得超出合法、正当、必要的范围进行处理。
4.5 服务期限与数据保留#
用户应关注服务器及其他付费资源的使用期限，并及时完成续费。
服务到期后，数信云可按照事先公示的产品规则暂停相关资源的运行或访问权限。
如果您需要继续使用服务器或保留相关数据，请在服务到期前及时续费或完成数据备份、下载与迁移。
对于到期后未续费的实例，数信云可在履行必要通知及相关程序后，按照已公示的资源保留和清理规则删除相关实例及业务数据。数据删除后可能无法恢复。
具体数据保留期限及资源销毁规则，以购买时已经明确告知用户的有效产品规则或双方另行约定为准。
4.6 网络连接与访问#
数信云部分计算资源部署于中国境内数据中心，网络访问应遵守中国相关法律法规及网络管理要求。
访问境外网站或计算资源时，连接速度及可用性可能受到网络环境、目标服务器及其他因素影响。
用户不得利用数信云资源非法建立跨境网络连接或提供未经许可的代理服务。
对于用户自行安装的第三方网络工具，数信云原则上不承担软件配置或使用支持义务。
4.7 GPU计算服务#
数信云提供独享或共享GPU计算服务，实际可用GPU型号、显存、数量、算力配额及使用方式以产品说明和订单为准。
用户应合理使用GPU资源，不得通过恶意进程、违规抢占或绕过调度限制等方式影响其他用户。
对于共享GPU服务，数信云不保证用户在任何时刻均可独占全部物理GPU资源，除非购买的产品明确提供此项保障。
使用GPU计算资源的用户，还应遵守数信云依法公示的相应GPU产品使用规则（如有）。
五、个人信息和隐私保护#
数信云重视用户的个人信息与隐私保护，并将按照《中华人民共和国个人信息保护法》等相关法律法规及平台《隐私政策》，依法处理用户个人信息。
为提供账户注册、实名认证、订单管理、资源交付、技术支持及安全保障等服务，数信云可能在必要范围内处理用户身份信息、联系方式、订单信息及相关运行日志。
数信云不会非法出售、泄露或者向第三方提供用户个人信息。 对依法需要向第三方提供或委托处理个人信息的情形，数信云将依法履行相应义务。
未经合法授权或其他法定处理依据，数信云不得擅自访问、使用或向第三方披露用户存储的科研数据、程序代码及其他业务资料。
用户依法享有查询、复制、更正、补充、删除个人信息以及注销账户等权利，具体规则以平台《隐私政策》及适用法律法规为准。
六、有限责任与数据安全#
数信云提供云服务器、计算、存储及相关基础设施服务。用户应自行负责其部署的软件、运行的代码、科研任务及相关数据的合法性与安全管理。
用户应及时对重要数据进行备份，不应将单一云服务器实例作为重要科研数据、程序代码或其他业务资料的唯一存储位置。
因用户自行误操作、错误配置、删除文件、程序缺陷等原因造成的数据丢失或服务异常，数信云将在合理技术能力范围内提供必要协助，但不保证能够恢复全部数据。
对于因数信云未依法履行安全保障义务、未按照服务约定履行责任或其他依法应当由数信云承担责任的情形，数信云应依法承担相应责任。
已删除或被覆盖的数据可能难以恢复。为降低数据丢失风险，建议用户采取以下措施：
使用适当的文件回收机制，避免直接永久删除重要数据。
使用Git等版本控制工具管理程序代码。
对重要数据定期执行异地备份。
根据实际提供的服务，使用快照或备份产品保护重要数据。
数信云将采取合理的技术和管理措施维护平台运行安全。但由于互联网及计算系统的复杂性，除非另有明确约定，数信云不对服务绝对不中断或所有软件环境完全无故障作出保证。
发生影响服务运行的故障、安全事件或其他异常情况时，数信云应及时采取合理措施进行排查和处置，并依法履行必要的通知义务。
七、违约责任及处理措施#
若数信云发现或收到有效举报，认为用户存在违反法律法规、本协议或相关服务规则的行为，有权根据具体情况开展调查核实，并依法采取必要的管理措施。
管理措施包括但不限于：
警告并要求限期整改。
限制异常计算任务或网络访问。
暂停部分或全部服务器服务。
限制违规账户的相关操作权限。
对严重违法违规账户依法终止服务。
按照法律法规要求配合有关部门处理。
对于可能严重危害平台、其他用户或第三方安全的紧急行为，数信云可以依法先行采取必要的紧急处置措施，并根据实际情况及时通知相关用户。
对于其他一般违约行为，数信云应根据风险程度和实际情况给予适当整改机会。
因用户违法违规行为给数信云或第三方造成损失的，用户应依法承担相应责任。
用户认为相关处置存在错误的，可以通过平台客服渠道提出申诉。数信云将在合理期限内进行核查处理。
八、争议解决及其他#
本协议的订立、履行、解释及争议解决，适用中华人民共和国法律。
因本协议引起的争议，双方应首先友好协商解决。协商不成的，任何一方均有权依法向有管辖权的人民法院提起诉讼。
如本协议任何条款被依法认定为无效、不可执行或不具有法律约束力，不影响其他有效条款的法律效力。
本协议经用户以合法有效方式确认后生效，并适用于双方约定范围内的相关服务。
本协议未尽事项，按照适用法律法规、双方有效的特别约定及依法公示的平台规则执行。
九、退款规定#
数信云云服务器、GPU计算、存储及其他付费产品的退款条件、退款方式和退款计算规则，以用户购买时已明确展示的退款政策、产品说明及双方有效约定为准。
用户购买前应认真核实服务器规格、资源配置、使用期限、系统环境及其他产品限制。
对于符合退款条件的订单，用户可按照数信云公布的退款申请流程提出申请。
因数信云自身原因导致产品或服务无法按照约定提供的，用户依法享有相应的补救、费用减免、解除合同或退款等权利。
对于特定优惠产品、定制化服务及特殊计算资源，如存在退款限制，数信云应在用户购买前予以明确说明，相关条款不得违反法律法规的强制性规定。

Shuxinyun Cloud User Service Agreement#
Welcome to Shuxin Cloud!
Important Notice: Before registering for or using Shuxin Cloud, please carefully read and fully understand this Shuxin Cloud User Agreement (the "Agreement"), particularly the provisions concerning real-name identity verification, acceptable use, data security, service suspension, limitations of liability, refunds, and dispute resolution. Provisions that may materially affect your rights and interests are highlighted in bold for your attention.
By completing the registration process, checking the box indicating your acceptance of this Agreement, or otherwise expressly agreeing to this Agreement through a legally valid method, you acknowledge that you have read, understood, and agreed to comply with its terms.
If you do not have full legal capacity to enter into this Agreement, you should review it under the guidance of your legal guardian, who shall determine whether to accept this Agreement and complete the relevant procedures on your behalf in accordance with applicable laws.
Contracting Parties#
This Agreement is entered into between individuals, enterprises, or other organizations using the Shuxin Cloud platform (hereinafter referred to as "User" or "you") and Jiangsu Shuxin Cloud Technology Co., Ltd. (hereinafter referred to as "Shuxin Cloud," the "Company," "we," or "us").
Shuxin Cloud is a cloud computing and scientific computing service platform operated by Jiangsu Shuxin Cloud Technology Co., Ltd.
Agreement Content and Effectiveness#
This Agreement consists of its main text and the Privacy Policy, Refund Policy, product descriptions, service rules, notices, and other relevant policies and documents that Shuxin Cloud has published or may lawfully publish in the future (collectively, the "Platform Rules"). Such Platform Rules, where legally valid and properly disclosed to Users, form an integral part of this Agreement.
Shuxin Cloud may amend this Agreement and related rules in response to changes in applicable laws and regulations, technological developments, or business operations. For changes that materially affect Users' rights and interests, we will generally provide at least seven (7) days' advance notice through website announcements, in-platform notifications, emails, text messages, or other reasonable means, unless otherwise required by applicable laws.
If you do not agree to the amended Agreement, you may discontinue the relevant services before the amendments take effect and arrange for data backup, migration, cancellation, or other necessary procedures in accordance with applicable rules. Where renewed consent is required by law, Shuxin Cloud will obtain such consent through the appropriate procedures.
Where the parties have entered into a separate written service agreement containing provisions inconsistent with this Agreement, the legally valid specific provisions of that agreement shall prevail.
Service Description#
Shuxin Cloud primarily provides cloud computing resources and related technical services to researchers, universities, research institutions, and other Users with computing requirements. These services include, but are not limited to:
Cloud Server Services: Independent or shared computing environments based on virtualization, containerization, and related technologies.
CPU Computing Services: Multi-core CPU computing resources for scientific research, data processing, and other lawful computing tasks.
GPU Computing Services: GPU-accelerated computing resources for deep learning, bioinformatics, artificial intelligence, and other lawful computing tasks.
Storage Services: Cloud-based data storage and related storage resource management functions.
Scientific Computing Environments: Computing environments suitable for bioinformatics, data science, and related research fields.
Management Console: Server and computing resource management functions provided through the Shuxin Cloud Luban Console and other management tools.
Shuxin Cloud provides infrastructure and platform-level technical support associated with the purchased services, including troubleshooting and handling issues relating to server operation, computing resources, network connectivity, storage, and the underlying platform environment.
Unless otherwise agreed, Shuxin Cloud is generally not obligated to provide free technical support for third-party software installed by Users, program debugging, algorithmic errors, dependency conflicts, or other issues unrelated to the underlying platform infrastructure.
Different computing products may vary in terms of CPU, GPU, memory, storage, networking, and system privileges. Performance and availability of shared computing resources may be affected by concurrent workloads and resource scheduling. Users should select configurations appropriate to their requirements based on the relevant product descriptions.
Shuxin Cloud may reasonably upgrade, optimize, and maintain its service functions, resource scheduling systems, and related software for technical and operational purposes. Material service changes shall be communicated in accordance with this Agreement and applicable laws.
Acceptable Use Policy#
4.1 Lawful Use#
Users shall use the server, network, storage, and computing resources provided by Shuxin Cloud in a lawful and reasonable manner and comply with all applicable laws and regulations.
Products primarily intended for scientific computing shall be used in accordance with their respective product descriptions. Without prior authorization from Shuxin Cloud, shared servers subject to usage restrictions must not be used for website hosting, commercial service operations, public proxy services, or other purposes inconsistent with the applicable product terms.
Users are strictly prohibited from using Shuxin Cloud services to engage in any of the following activities:
Unauthorized intrusion into, scanning of, or attacks against other computer systems or networks.
Distribution of viruses, Trojans, ransomware, or other malicious software.
Telecommunications or online fraud, illegal online gambling, phishing, or other unlawful activities.
Deployment of unlawful network proxies, unauthorized network relay services, or services that violate applicable network regulations.
Cryptocurrency mining without the platform's permission.
Unauthorized access to other Users' servers, files, or data.
Unlawful collection or distribution of personal information or other legally protected data.
Any other activities that compromise the security of Shuxin Cloud, infringe upon third-party rights, or violate applicable laws and regulations.
4.3 Instance Privileges and Account Security#
Users may access only their own server instances and computing resources, or those they are legally authorized to use. Attempts to access another User's instances, files, system processes, or administrative privileges without authorization are prohibited.
Administrative privileges granted within a cloud server or container are limited to the corresponding instance. Such privileges do not confer administrative access to the underlying physical servers, host systems, virtualization infrastructure, or storage clusters.
Users must not exploit security vulnerabilities, perform container escapes, escalate privileges, or otherwise attempt to bypass instance isolation boundaries or access underlying infrastructure.
Users are responsible for safeguarding account passwords, SSH keys, access tokens, and other authentication credentials. Accounts must not be sold, rented, lent, or unlawfully transferred to third parties.
To maintain platform security, Shuxin Cloud may monitor and analyze resource utilization, login logs, abnormal network traffic, and relevant security events to the extent that such activities are lawful, legitimate, and necessary. Any processing of personal information shall comply with applicable laws and the platform's Privacy Policy.
4.4 Real-Name Verification and Mobile Number Binding#
In accordance with the Cybersecurity Law of the People's Republic of China, the Anti-Telecommunications and Online Fraud Law of the People's Republic of China, and other applicable laws and regulations, Shuxin Cloud implements real-name identity verification for cloud services that are legally subject to such requirements.
Before using relevant cloud server and cloud computing services, Users must provide true, accurate, and valid identity information and complete the required real-name verification procedures.
To strengthen account security, prevent unauthorized access, and facilitate the delivery of important security notifications, Shuxin Cloud also requires Users to bind a mobile phone number to their accounts.
Shuxin Cloud shall not provide cloud services that legally require real-name verification to Users who have not completed the required verification. For Users who have not completed the platform's required mobile number binding or identity verification procedures, Shuxin Cloud may, in accordance with applicable laws and published Platform Rules, restrict access to relevant service functions or the management console.
Users are responsible for the authenticity and accuracy of the information they submit and must update their verification information promptly when it changes.
Shuxin Cloud will protect identity verification information and other personal information in accordance with applicable laws and shall not process such information beyond what is lawful, legitimate, and necessary.
4.5 Service Term and Data Retention#
Users are responsible for monitoring the expiration dates of their servers and other paid resources and arranging renewals in a timely manner.
Upon service expiration, Shuxin Cloud may suspend the operation of or access to the relevant resources in accordance with previously published product rules.
If you wish to continue using your server or retain your data, you must renew the relevant services or complete the necessary data backup, download, and migration procedures before expiration.
For instances that remain unrenewed after expiration, Shuxin Cloud may delete the relevant instances and business data in accordance with previously published resource retention and deletion rules, subject to any required notifications and procedures. Once deleted, such data may be irrecoverable.
The applicable data retention periods and resource deletion rules shall be governed by the valid product terms clearly disclosed to Users at the time of purchase or by any separate agreement between the parties.
4.6 Network Connectivity and Access#
Certain Shuxin Cloud computing resources are hosted in data centers located within mainland China. Network access must comply with applicable Chinese laws, regulations, and network management requirements.
When accessing overseas websites or computing resources, connection speed and availability may be affected by network conditions, destination servers, and other factors.
Users must not use Shuxin Cloud resources to establish unlawful cross-border network connections or provide unauthorized proxy services.
Shuxin Cloud is generally not obligated to provide software configuration or usage support for third-party networking tools installed by Users.
4.7 GPU Computing Services#
Shuxin Cloud provides dedicated or shared GPU computing services. The available GPU models, video memory capacity, GPU quantities, computing quotas, and usage arrangements shall be determined by the applicable product descriptions and orders.
Users must use GPU resources reasonably and must not interfere with other Users through malicious processes, unauthorized resource monopolization, or circumvention of scheduling restrictions.
For shared GPU services, Shuxin Cloud does not guarantee that a User will have exclusive access to the entire physical GPU at all times unless such exclusivity is expressly included in the purchased product.
Users of GPU computing resources must also comply with any applicable GPU product usage rules lawfully published by Shuxin Cloud.
Personal Information and Privacy Protection#
Shuxin Cloud is committed to protecting Users' personal information and privacy. Personal information will be processed in accordance with the Personal Information Protection Law of the People's Republic of China, other applicable laws and regulations, and the platform's Privacy Policy.
To provide account registration, real-name verification, order management, resource provisioning, technical support, and security protection, Shuxin Cloud may process identity information, contact details, order information, and relevant operational logs to the extent necessary.
Shuxin Cloud will not unlawfully sell, disclose, or provide Users' personal information to third parties. Where personal information must lawfully be provided to third parties or processed by entrusted service providers, Shuxin Cloud will fulfill its applicable legal obligations.
Unless legally authorized or otherwise permitted under an applicable legal basis, Shuxin Cloud shall not access, use, or disclose Users' stored research data, source code, or other business materials without authorization.
Users have the rights, as provided by applicable law, to access, copy, correct, supplement, and delete their personal information, as well as to request account cancellation. Detailed procedures shall be governed by the platform's Privacy Policy and applicable laws.
Limitations of Liability and Data Security#
Shuxin Cloud provides cloud servers, computing resources, storage, and related infrastructure services. Users are responsible for the legality and security of the software they deploy, the code they execute, their research activities, and the data they process.
Users are responsible for regularly backing up important data and should not rely on a single cloud server instance as the sole storage location for critical research data, source code, or other important materials.
Where data loss or service disruption results from User errors, incorrect configurations, accidental file deletion, software defects, or similar causes attributable to the User, Shuxin Cloud will provide reasonable assistance within its technical capabilities but does not guarantee complete data recovery.
Where Shuxin Cloud fails to fulfill its legally required security obligations, breaches its contractual service commitments, or otherwise incurs liability under applicable law, Shuxin Cloud shall bear the corresponding legal responsibility.
Deleted or overwritten data may be difficult or impossible to recover. To minimize the risk of data loss, Users are encouraged to take the following precautions:
Use appropriate file recovery or recycling mechanisms instead of permanently deleting important files.
Use version control tools, such as Git, to protect source code.
Perform regular off-site backups of critical data.
Use snapshot or backup services where such services are available.
Shuxin Cloud will implement reasonable technical and organizational measures to maintain platform security and stability. However, due to the inherent complexity of internet and computing systems, Shuxin Cloud does not guarantee uninterrupted service or completely error-free software environments unless expressly agreed otherwise.
In the event of system failures, security incidents, or other abnormal conditions affecting service operations, Shuxin Cloud will take reasonable measures to investigate and address the issues and fulfill any applicable legal notification obligations.
Breach of Agreement and Enforcement Measures#
If Shuxin Cloud identifies, or receives a credible report of, conduct that may violate applicable laws, this Agreement, or relevant service rules, it may investigate the circumstances and take necessary management measures in accordance with applicable law.
Such measures may include, but are not limited to:
Issuing warnings and requiring corrective action within a specified period.
Restricting abnormal computing workloads or network access.
Suspending some or all server services.
Restricting certain operations associated with non-compliant accounts.
Lawfully terminating services in cases of serious violations.
Cooperating with competent authorities as required by applicable laws and regulations.
Where conduct may pose an immediate and serious threat to the security of the platform, other Users, or third parties, Shuxin Cloud may take necessary emergency measures in accordance with applicable law and notify the affected Users as appropriate.
For other non-urgent violations, Shuxin Cloud shall, where appropriate, provide a reasonable opportunity for corrective action based on the nature and severity of the violation.
Users shall bear legal responsibility, as applicable, for losses caused to Shuxin Cloud or third parties by their unlawful or non-compliant conduct.
Users who believe that enforcement measures have been applied incorrectly may submit an appeal through the platform's customer support channels. Shuxin Cloud will review and handle such appeals within a reasonable period.
Dispute Resolution and Miscellaneous Provisions#
The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.
Any dispute arising from or relating to this Agreement shall first be resolved through amicable consultation between the parties. If no resolution can be reached, either party may bring legal proceedings before a People's Court having jurisdiction in accordance with applicable law.
If any provision of this Agreement is held to be invalid, unenforceable, or legally ineffective, such determination shall not affect the validity or enforceability of the remaining provisions.
This Agreement shall take effect upon the User's legally valid acceptance and shall apply to the relevant services within the agreed scope.
Matters not expressly addressed in this Agreement shall be governed by applicable laws and regulations, valid separate agreements between the parties, and lawfully published Platform Rules.
Refund Policy#
Refund eligibility, refund methods, and refund calculations for Shuxin Cloud servers, GPU computing services, storage services, and other paid products shall be governed by the Refund Policy, product descriptions, and valid agreements expressly disclosed to Users at the time of purchase.
Before purchasing, Users should carefully verify server specifications, resource configurations, service terms, system environments, and other applicable product limitations.
For orders that meet the applicable refund conditions, Users may submit refund requests in accordance with the refund application procedures published by Shuxin Cloud.
Where products or services cannot be provided as agreed due to causes attributable to Shuxin Cloud, Users shall be entitled to appropriate remedies, fee reductions, contract termination, refunds, or other rights available under applicable law.
If refund restrictions apply to promotional products, customized services, or special computing resources, Shuxin Cloud shall clearly disclose such restrictions before purchase. Such restrictions must not violate mandatory provisions of applicable laws and regulations.
